The Supreme Court has finalized a sevenyear prison sentence for former President Yoon Suk Yeol on charges including obstructing his arrest and abuse of power. This ruling is the first final judgment in a criminal trial related to the former president, issued about 1 year and 7 months after the martial law declaration.
The Supreme Court found him guilty of using the Presidential Security Service to obstruct the Corruption Investigation Office for Highranking Officials' execution of an arrest warrant, and of infringing the right to deliberate by excluding some Cabinet members from the Cabinet meeting held to declare emergency martial law. It also stated that the president's immunity from prosecution does not block an investigation itself during tenure, and that the CIO's investigation and execution of the warrant were lawful.
This decision is also likely to affect the case of the chief ringleader of insurrection currently underway at the Seoul High Court. Although the Supreme Court did not separately determine whether the December 3 emergency martial law was unconstitutional or illegal, it upheld the lower court's finding of illegality.
