Revision of the implementing regulations for the Auditing Law: strengthen the Party’s leadership over auditing work and refine the scope of audits Improve procedures and corrective responsibilities, enhance supervisory effectiveness, and help make fiscal management more standardized

Premier of the State Council Li Qiang recently signed a State Council decree promulgating the revised Implementing Regulations of the Audit Law of the People's Republic of China, which will take effect on December 1, 2026. The new regulations consist of 7 chapters and 64 articles, and further refine audit supervision, procedures, and rectification responsibilities. One of the revisions is to strengthen the Party's leadership over audit work, making it clear that audit work should adhere to the leadership of the Communist Party of China and implement relevant lines, principles, and policies as well as the Party Central Committee's decisions and arrangements. The regulations also refine the scope of audit over fiscal revenues and expenditures, include draft final accounts of public finance and the management and use of stateowned resources and stateowned assets in audit result reports, and clarify the scope of application for certain major public works projects. In terms of procedures, the new regulations add provisions requiring the registration and reporting of acts that interfere with audit matters, and improve the requirements for relevant units to assist audits as well as the procedures for inquiring into deposits at financial institutions. Regarding rectification responsibilities, the regulations make clear that the audited entity bears the principal responsibility for rectification, while requiring audit institutions to track and inspect the progress of rectification. The departments under the State Council, local governments, and others are to strengthen overall coordination,督促 issue rectification, and improve relevant systems.
