Chinese Premier Li Qiang recently signed a State Council decree promulgating the revised Regulations on the Protection of LayoutDesigns of Integrated Circuits, which will take effect on October 15, 2026.
The purpose of this revision is to strengthen the protection of exclusive rights in layoutdesigns of integrated circuits and promote technological innovation and scientific and technological development. The regulations consist of 6 chapters and 54 articles, covering areas such as overall requirements, application and examination, rights protection, and application and commercialization.
After the revision, the regulations further clarify the principles of protection work, improve the rules on fraudulent applications, material requirements, rejection and revocation procedures, and add a rights restoration mechanism. At the same time, the regulations also increase compensation for infringement, strengthen public services, and improve relevant provisions on transfer, licensing, and pledge.
