Not guilty for a woman who drove under the influence while being assaulted
Not guilty of drunk driving, recognition of necessity as a woman who was a victim of quasi-rape Driving to escape an isolated lodging in the early morning, check the reasons for the ruling
The court acquitted a woman who had been sexually assaulted and drove in an attempt to get away from the male perpetrator. The Chungju branch of the Cheongju District Court determined that the situation constituted necessity.
The incident took place in June last year at a lodging establishment in Chungju. The victim was brought to trial on charges of driving about 10 meters while her blood alcohol concentration was 0.094%, but the court found that, given the remote lodging environment at the time and the earlymorning hour, it would have been difficult for her to seek other help.
The court explained that it was difficult to hold the woman responsible for drunk driving. The male perpetrator separately received a threeyear prison sentence on charges of quasirape.
