As the Ministry of Justice announced that it would swiftly revise the crime of breach of trust, attention is focused on how this may affect President Lee Jaemyung’s trial related to the Daejangdong case.
Justice Minister Jeong Seongho said at a briefing at the Government Complex Gwacheon on the 5th that the elements of the crime of breach of trust are unclear and place a burden on corporate management, and that he would quickly review reform measures such as abolishing the crime or clarifying its requirements. The Ministry of Justice is looking into both a plan to refine the current rules and a plan to create a special law to replace them.
If the crime of breach of trust is abolished or significantly changed, legal issues could also arise in the trial of President Lee, who was indicted on breachoftrust charges in the Daejangdong case. However, Minister Jeong drew a line against interpretations that this measure was taken with the President’s case in mind. Along with this, the Ministry of Justice is also reviewing the legal basis for the joint investigation headquarters and the issue of prosecutors dispatched to the special counsel.
