According to a survey by Workplace Bullying 119 of 1,000 workers nationwide, the share who said they can freely use parental leave was 53.3% overall.
However, there were large differences depending on employment type and workplace size. While 63.7% of regular employees said they could use it freely, only 37.8% of nonregular employees did, and the figure was even lower among female nonregular employees at 29.8%. Workplaces with fewer than 5 employees also stood at just 31.4%, showing a wide gap compared with workplaces with 300 or more employees (69.5%).
Under current law, maternity leave and parental leave systems apply regardless of workplace size, but workplaces with fewer than 5 employees are excluded from the remedy procedures for unfair dismissal, making it difficult to receive prompt protection even when rights are violated, according to criticism.
