Hainan Issues Positive and Negative Lists for Government-Business Interactions to Standardize the Boundaries of Government-Enterprise Engagement

On July 21, the General Office of the Hainan Provincial Party Committee issued the "Guidelines for Conduct in Interactions Between Government and Business in Hainan Province," which define positive and negative lists from both the government and enterprise perspectives, further clarifying the boundaries of governmentbusiness interactions and promoting a marketoriented, lawbased, and international business environment. For the government and public officials, the list encourages strengthening the interpretation of policies that benefit enterprises, maintaining regular communication on enterprise concerns, and advancing "extremely simplified approvals" in accordance with the law, standardizing inspections involving enterprises, promoting "comprehensive inspections at one visit" and "codebased inspections," while also improving integritybased performance and arrears governance mechanisms in areas such as procurement, bidding, financing, fund disbursement, and investment attraction. The negative list sets out "six strict prohibitions," including abuse of authority in regulation, breach of contract and dishonesty, interference in business operations, negligent or sluggish administration, powerformoney transactions, and profitseeking through relatives' connections. The document also sets requirements for enterprises and business entities, emphasizing lawful and compliant operations, support for scientific and technological innovation, and the cultivation of new quality productive forces, and lists six prohibited behaviors to prevent the use of improper means to interfere with market activities or to funnel利益 to public officials.
