Former FBI Director James Comey has asked a federal judge to dismiss the indictment against him over an Instagram post that showed seashells arranged as “8647,” according to court filings Monday.
His lawyers argue the post was protected political speech and did not amount to a “true threat” against President Donald Trump. They say the number combination has been used as a slogan opposing Trump, not as a call for violence.
Comey was indicted in April in federal court in North Carolina on charges of threatening the president and transmitting a threat in interstate commerce. The case comes amid longrunning tensions between Comey and Trump, who fired him as FBI director in 2017.
